There is a sequence here whereby after two letters Mr. Les Weaver finds himself as a non-citizen of Shady Cove, after the city' response on the 3rd letter. He does indeed respond on the 4th letter. Now, question is, if Mr. Weaver were in the need to call for Shady Cove Police, would he be ignored? Citizens in Shady Cove have previously found themselves in that situation.

This letter is response to the notice of Ordinance 165 published in both the May 14, 2002 edition of the Upper Rogue Independent and the June 2002 issue of the Insider. Although the mayor claims to be the editor of the Insider, your staff is known to prepare this document and in addition, the persons responsible for correcting the following complaint are under your supervision and direction.

First I present a brief history on this subject.  Last year the city published that portion of Ordinance 165 concerning weed abatement as a fire hazard. Like this year, the citizens were seemingly encouraged to respond in consideration of fire safety.  The response was to be the filing of a complaint with the city for investigation and upon a finding of merit the city would turn the problem over to County Fire District 4. This year that procedure has seemingly changed. That change may be incorrect.

Another problem is that in 2001 five property owners collectively signed a complaint in this neighborhood. Although I was not a signatory to that complaint, I alone was selectively disparaged by the city in a legal procedure on February 21, 2002 for the 2001 complaint, this as another example of the city’s blind haste to again harass me. I now assume that this complaint will result in either of two possibilities. One is that I have a freebie to be a signatory to a complaint without further disparagement. Second is that I run the risk of the city passing a Resolution in attempt to tar, feather, and deport me for advancing to a complaint signatory. Because fire safety is the principal consideration, I must take the risk of the city openly resolving the latter.

In summation, this letter is FORMAL COMPLAINT that the city property along the north border of Train Lane west of Cora violates the city’s own Ordinance 165 as it applies to a fire hazard and by that neglect endangers our home and property. Because Public Works has suddenly demonstrated a reprieve of having Karla’s and my property under surveillance, (though suspected temporary), it would seem that under your command, Public Works now should have manpower to bring this city property into compliance with Ordinance 165.  This will also answer whether public service and safety is the new priority or if harassment continues as foremost intention.

Because of the medical absence of the police secretary of record, I address this request directly to you for response.

I request copy of police complaint 02-125 to which I was complainant and that it be available for me to pick up at city hall five working days from receipt of this letter.  The information should include any charges and disposition of charges against both the person alleged to have supplied the improper use of city property and resources as well as the person who accepted the property and resource, the latter commonly referred to in police vernacular as “the fence”. Because the complaint questions the misuse of public property, I believe it appropriate to assure the taxpaying electorate that public property and resources are not being misused.Surely you would agree that the public also deserves reassurance that your office protects their property and resources from misuse or pilferage by anyone.

We have been advised that such documents are available within three days of request. Failure to respond would therefore be in direct contradiction to that assurance and therefore require I pursue other avenues to obtain these documents.

In the event I receive no response, I am also prepared to report this entire matter to the Jackson County District Attorney and the State Attorney General for their investigation and consideration.

UPDATE:

     June 6, 2002, the asphalt in front of Fire District 4 in Shady Cove was patched and resealed.  During the cure time the area had to be barricaded from traffic by closing access from highway 62. That barricade was a yellow ribbon, approximately 3” wide with the word “CAUTION” repeated in large black letters.  Across the highway and only a short distance south on highway 62 is where the “POLICE / FIRE LINE - DO NOT CROSS” tape was used to barricade for a councilor’s paving project.  This demonstrates that even the fire department will not misuse public property for a non-emergency nor abuse the public trust that the city covers up.

I believe your letter of June 5, 2002 has overstepped the executive powers granted any city administrator and has trespassed into the judicial branch of government.  In response I reference two of my recent letters to you.

First is my letter of 6-03-02.  Although there has been improvement, the city’s property is among those continuing in violation of Ordinance 165 in this neighborhood.

Second is my letter of 6-06-02 requesting certain information, which I believe I have right to. I expect photocopy of that information mailed to me or advise of its availability for pick up at city hall. Charges for photocopy will be made by return mail.
