You will recall that in September 2001, Karla and I had a fill of the threats, harassment, slander, defamation and intimidation emanating from the Shady Cove city hall, including the specific attacks by Anderson, Johnson and Bostic. On September 4, 2001 we filed a formal complaint in the Medford Federal District Court. At that time, you will recall that we stated the likelihood that it would make at least one trip and likely two trips to the 9'th District in San Francisco. This morning, notice of the first journey was filed in the Federal Court. It was filed electronically and as soon as we receive copy, it will be forwarded to you to dispel the rumors promoted by city hall. We reserve the right to redact any portions we choose. Within thirty days, the formal papers will be filed. Then one to two years will pass for that court to schedule oral arguments and render a decision for or against remand for trial.

Long ago, Karla and I posted a certified letter to the city administrator arguing that the city would not succeed in running us out of town as it has others. This in spite of the very strong suggestion by more than one city official during council meetings that we leave town, thereby gaining a courteous " thank you " from the mayor. As response to our complaint, on 6-05-02, the city administrator posted a letter ordering, "Because litigation is pending, all communication with the city should be addressed through your attorney, [name withheld]"

In effect, until Chief Gibson over-rode that order, Karla and I had not even police protection because the Administrator was the micro-manager of the police department. In addition, until Chief Gibson was made aware of the details, both the unsupervised police and Bostic's nephew (the registered felony sex offender) harassed us.

However, the removal of our right to enter the city hall or face our government except to pay sewer bills, stands under possible threat of " criminal trespass ". As with other city hall orders, this is unconstitutional. The result is that we put our house on the market and sale is pending. Contrary to our argument and challenge, the city has run us out of town. If the 9' th remands our complaint for trial, we will amend the complaint to include all of the above, additional defendants and more. Tyranny must be brought down.

As to your invited guest, Chief Gibson, he is a godsend to this community. We know we are far from alone in abject loathing for this pit of tyranny. However, both Karla and I see the use of the police department as a political weapon of a dictatorship crumbling.

In the last month, Karla and I have felt more police protection than in the total of the past three plus years. For that we thank Chief Gibson for when it comes to equal and fair justice, he is 180 degrees from the " Johnson era ".

Karla and I wish him the very best. You people are the ones that can provide that best by openly and actively support him. It is certain he won't get the best from city hall unless you do.

Karla's and my future interface with this city will be limited to the legal arena. Although we are aware that a number of you, given the right offer, would leave Shady Shady, for now you must continue to live here until this tyranny is brought down. We suggest you carefully consider the issues being put before you today for with devotion to the intended target and hard work you can overturn this tyranny at the ballot box. With Gibson here, you have a cause.
