| Ordinances, The Political Hammer of many Small Towns
The following is not
presented as definition from a legal scholar but
rather the view from,
and experience of, a common
citizen.
. . . Ordinances include:
"Laws", passed by, and generally
limited to, a city.
The intent is to set standards,
etc. for the mutual benefit of all citizens. Once
an ordinance is
passed, complaint violation can
normally be filed by the controlling city
department, such as
planning or building
departments and many times by citizens for such
things as animal control,
unsafe conditions or unhealthy
conditions.
The police perform enforcement
with the city attorney and municipal court the
judicial arm that
confronts and administers
penalty for violation.
. . . The taxpayers pay for all
persons opposing the citizen. But, what happens
if a citizen digs in
and fights back?
If the citizen disagrees, hires
legal counsel and wins the argument, the city
looses nothing while the
citizen is out hundreds,
perhaps thousands, of dollars in legal fees as
reward for pleading " not
guilty " . If the citizen
concludes he is victim of political persecution,
he may find it cheaper to pay
a fine, sell his home and leave
town.
. . . If the citizen fights
back, cost may not be the only penalty. He may
then be labeled as a
" troublemaker " and
through back room whispers of conspiracy, ordered
not to enter
certain " buddy "
businesses under threat of arrest for "
criminal trespass ", again by the same
police and before the same
court.
" The harassment
possibilities of reprisal by a city, under the
cloak of being legal, are infinite ".
